These Terms of Service ("Terms") govern your access to and use of cedarjacfarms.com, including all content, features, products, and services offered on or through the site (the "Services"), operated by CedarJac Farms LLC ("CedarJac Farms," "we," "us," or "our"), a Nebraska limited liability company.

By accessing or using the Services, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order through the Services. By using the Services, you represent that you meet this requirement.

2. Products and Availability

We sell farm and homestead products, which may include but are not limited to eggs, produce, and other seasonal goods. Product availability, descriptions, and pricing are subject to change without notice. We reserve the right to limit quantities, refuse or cancel any order, and correct pricing or listing errors at our discretion, including after an order has been placed.

Farm products are seasonal and subject to natural variation. Photos are representative and may not reflect the exact appearance, size, or quantity of the product received.

3. Orders, Payment, and Pickup/Delivery

All orders are processed through Shopify. Payment is due at the time of purchase unless otherwise stated. You are responsible for providing accurate payment, contact, and delivery/pickup information.

If your order involves on-farm pickup or local delivery, you are responsible for retrieving or being available for your order within any stated pickup window. We are not responsible for product quality issues arising from delayed pickup.

4. Product Disclaimers and Assumption of Risk

Farm and food products carry inherent risks. By purchasing food products from CedarJac Farms, you acknowledge and accept the following:

• Products are minimally processed and may not be subject to the same inspection standards as commercially processed goods.
• If any product is sold under a state cottage food, on-farm, or similar regulatory exemption, that product has not been produced in a certified commercial kitchen or inspected by the applicable state agency, and required disclosure language will accompany that product's listing and packaging.
• You are solely responsible for evaluating whether a product is appropriate for your own consumption, including if you are pregnant, immunocompromised, elderly, or have any relevant allergy, sensitivity, or medical condition.
• Ingredient and allergen information is provided to the best of our ability, but we cannot guarantee an environment free of cross-contact with common allergens.

No products sold through this site are intended to diagnose, treat, cure, or prevent any disease, and nothing on this site should be taken as medical advice. Consult a physician before making changes to your diet, especially if pregnant, nursing, or managing a medical condition.

5. Limitation of Liability

To the fullest extent permitted by law, CedarJac Farms LLC, its owners, and employees are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Services or consumption of any product purchased through the Services. Our total liability for any claim arising from your purchase is limited to the amount you paid for the product giving rise to the claim.

Nothing in this section limits liability that cannot be limited under applicable law.

6. Returns, Refunds, and Cancellations

Due to the perishable nature of our products, all sales are final once an order has been picked up or delivered, except as described below.

Damaged or incorrect items. If your order arrives damaged, spoiled on arrival, or is not what you ordered, contact us within 24 hours of pickup or delivery at charissajac@gmail.com or +1 402-202-0551 with your order number and a photo of the item. We will review each report individually and, at our discretion, offer a replacement, store credit, or refund.

Order cancellations. Orders can be canceled or changed only before they are prepared for pickup or delivery. Once an order enters preparation, it cannot be canceled or refunded, since farm goods are prepared and set aside specifically for that order.

Missed pickup. If you do not retrieve your order within the stated pickup window, we are not able to guarantee product quality and no refund or replacement will be issued for spoilage resulting from a missed or late pickup. Contact us as soon as possible if you need to reschedule.

Subscription or CSA orders. If you are enrolled in a recurring or subscription order, cancellations or pauses must be submitted at least 48 hours before the next scheduled charge or fulfillment date to take effect for that cycle.

What we do not refund:

• Buyer's remorse or change of preference after pickup/delivery
• Products consumed, opened, or used before a report was made
• Reports submitted more than 24 hours after pickup/delivery

This policy does not affect any rights you may have under applicable consumer protection law.

7. Digital Products and the Real Cost Calculator App

The Real Cost Calculator app ("the App"), available at app.cedarjacfarms.com, is a digital product offered under a one-time lifetime access license. By purchasing access to the App, you agree to the following:

No refunds. Because the App is a digital product delivered instantly upon purchase, all sales are final and non-refundable once access has been granted, regardless of how much or how little you use it. This applies whether access was purchased directly or unlocked through a promotional or discounted offer.

License, not ownership. Your purchase grants you a personal, non-transferable, non-exclusive license to use the App. You may not resell, share your access credentials, sublicense, or redistribute the App or its content.

Informational tool only. The App's cost comparisons, scratch-cost calculations, and ingredient flags are provided for general informational and educational purposes only. They are estimates based on the data and assumptions built into the tool and may not reflect actual prices, availability, or ingredient formulations at any given time or retailer. The App is not a substitute for reading product labels yourself, consulting a medical professional about dietary or health decisions, or independently verifying pricing before a purchase.

Ingredient flagging is not medical advice. The App's list of flagged ingredients reflects general research and is not a medical, dietary, or regulatory determination. We make no guarantee of the accuracy or completeness of this list, and it should not be relied on as the sole basis for any health-related decision, especially for individuals with allergies, medical conditions, or specific dietary restrictions.

Availability and changes. We may update, modify, limit, or discontinue features of the App at any time, including the free version's calculation limits, without obligation to compensate purchasers of the paid version. We will make reasonable efforts to maintain access to the App for lifetime-access purchasers, but we do not guarantee uninterrupted availability, and we are not liable for access issues caused by third-party infrastructure (e.g. Cloudflare) outside our control.

Account and access security. You are responsible for maintaining the security of any email or credentials used to access your purchase. We are not responsible for lost access resulting from using an incorrect or inaccessible email address at checkout.

8. Intellectual Property

All content on this site, including text, photos, recipes, graphics, logos, and the CedarJac Farms name and branding, is owned by CedarJac Farms LLC or used with permission, and is protected by copyright and trademark law. You may not reproduce, distribute, or use our content for commercial purposes without our written consent.

9. User Conduct

You agree not to use the Services to:

• Violate any applicable law or regulation
• Submit false or fraudulent orders or payment information
• Interfere with the operation or security of the site
• Scrape, copy, or republish site content without permission

We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion, including for suspected fraud or abuse.

10. Third-Party Services

The Services are hosted on Shopify and may use other third-party tools (payment processors, email/marketing platforms, analytics). We are not responsible for the practices or availability of third-party services, though we take reasonable care in selecting them. 11. Disclaimer of Warranties

The Services and all products are provided "as is" and "as available" without warranties of any kind, express or implied, except as required by law. We do not warrant that the site will be uninterrupted, error-free, or secure.

12. Indemnification

You agree to indemnify and hold harmless CedarJac Farms LLC and its owners and employees from any claims, damages, or expenses (including reasonable attorney's fees) arising from your violation of these Terms or misuse of the Services.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Services will be resolved in the state or federal courts located in Nebraska, and you consent to personal jurisdiction there.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms. We will update the "Last updated" date above when changes are made.
